The neighbor across the street, whose garage is at the top of a hill, left his Nissan Pathfinder running, with the parking brake off while he ran something into his house. When he came out he couldn't find his vehicle - that's because it is in my house! The car rolled down his driveway, gathering significant speed, across the street, down my driveway, blew out my double garage door like it wasn't even there, knocked my bike out of its way, came through the sheetrock and door leading into my house and came to rest in a hallway. Fortunately my daughter that was home at the time was upstairs. I arrived home for lunch about 3 minutes after it happened. I am not too concerned about the damage to the house, but I am worried that my bike will never be the same. I love my bike!

A man who can laugh after an event like this is a man that should live a long time. I'm one of those guys. I'd have laughed my ass off (except for the motorcycle, I agree). So since you said it, I will say I was laughing when I read it but man I still feel badly for you. Can't wait to see the pictures.

As Harry Caray would have said, "Holeeeeeeee cowwwwwwww!" I'm glad no one was hurt. That must have been a shock for your daughter to hear a SUV crashing through your house. I'm definitely looking forward to the pics.

Ed, I'd start pressuring the insurance co for a replacement bike right away. If there's more than just plastic damage, like bent frame and forks, it's a total. Get your BMW dealer to say so and don't try to salvage it. I'm glad nobody got hurt. The stuff is just stuff. It can be replaced. You were probably ready for a different color anyway. Kip

Rectifying the disaster should be entirely paid by the guy's auto or homeowner's insurance policy, including your bike and any other stuff inside the garage that was crushed, and damage to the house. The wall between the garage and the hallway was most likely a load-bearing wall. You might have structure damage that translates all the way up into the attic and outward through the house framing. And what about electrical/plumbing service lines in that wall. Damage to the internal flooring? If the guy has an insurance policy, it sure sounds like everything should work out, doesn't it! However, the guy's insurance policy is administered by an insurance company. It's not in the insurance company's interest to write checks. By no means rely on the guy's insurance company to make good. As much as I hate to say this, you need an attorney and a contractor to handle the claims, inspections, cost estimates, repair work, city permits, and the reams of administrative paperwork between your side and the guy's insurance company. But heh, have fun with it. C

Thanks for the supportive words and advice all. I found out I am already having issues with his insurance company - apparantly he is underinsured for the damage according to AAA. They told me to file a claim with my insurance company because his will most likely not cover all the damage. CA law requires minmum of $5k property which I assume he has. My guess is at least twice that assuming the bike isn't totaled. It doesn't look that bad but I can't tell - here's some pics. From whence it came:

It clipped the front right of the bike, bending the radiator off and knocking the bike on its side and pushing the the front over about 5 feet

I too am glad no one was injured and as others have said, stuff is just stuff. The house and the bike can be fixed or replaced although the hassle may be significant. But hey, you will get through it and hopeflully look back and laugh. But the guy who let his car get loose will never be able to live it down! The pictures will be interesting!

A good attorney will take care of you. Put a lien on his house if necessary. The hill in his driveway made the damage greater than it would have been without it.

Trying to get jaw closed after reading that!! Wow! Some lessons are best NOT learned the hard way and this is one of them. Hopefully it will all be repaired by insurance money, but damn, what a lot of trouble!! You'd best hug your daughter double today!!

I assume you are talking about his personal automobile insurance coverage? If he's underinsured there, I would also check with the company that has his homeowner's insurance to see if there is any fine print that allows his homeowner's coverage to cover any of this loss since the auto was on his property at the beginning of this "accident" (like a tree on his property falling on your roof). Also, I would inquire if this person has an "umbrella policy" that is in force to cover such accidents that are outside the coverage of basic auto/homeowner policies. I would also check to see if this auto that hit your property is leased/used for any business use - if so, I would then look at any business liability insurance that might be in place. Good luck.
